Introduction

This Privacy Policy (“Policy”) applies to information collection and use by Simplicity Patterns Inc. or its subsidiaries, including any Simplicity brand(s) you may interact with including Simplicity, McCalls, Butterick, Vogue Patterns, Know Me, NewLook, and Burda ("Simplicity," "we," "us," "our") while you are visiting and using our websites which link to this Policy (the "Sites"). Please read this Policy carefully to understand our practices. By accessing the Sites or any of the services offered on the Sites, you acknowledge that you have read, understood, and consent to this Policy.

 

The Information We Collect

As used in this Policy, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to an individual or household.

Simplicity collects Personal Information about the users of our Sites in several ways:

1. Individual Collection. We collect Personal Information from you directly when you fill out any forms on the Sites or email us requesting information. Also, depending on the Site or the services available to you on a Site, we may request specific Personal Information necessary to perform the services. For example, with some of our Sites, we may request body measurements necessary to help customize the sewing patterns you request.

You are under no obligation to provide any such information. However, if you should choose to withhold requested information, we may not be able to provide you with the services.

Following are the categories of Personal Information we may collect when you share it with us:

• Identifiers (e.g., name, address, company, phone number, email address, internet protocol address, other similar identifiers)

• Commercial information (e.g., interest in specific products and services, other similar information)

• Internet or other electronic network activity information (e.g., internet protocol address, browser type, cookies used for identification, and information regarding a consumer’s interaction with the Site)

2. Automatic Collection. As with all websites, there are certain elements of Personal Information which we automatically collect simply as a part of your interaction with the Sites. Along with the normal information necessary for us to present the Sites to you, we also use various technologies to collect Personal Information in connection with your use of the Sites.

Our web pages may incorporate "pixel tags", "web beacons", or other similar tracking technologies (collectively, "pixel tags") that allow us, or our agents, to track the actions of users of our Sites (known as “click-stream data”). Click-stream data can include Personal Information, such as the IP address of the computer you are using, the type of operating system and browser software that you use, the date and time of your access to our Sites, the website address, if any, from which you linked directly to our Sites, the website address, if any, to which you then travel from our Sites, and any similar traffic-related information.

We may also aggregate your click-stream data with similar data collected from other users in order to help us improve our Sites and the services we provide through our Sites. If we combine information which is not personal with Personal Information, we will consider the combined information as Personal Information.

 

3. Third Parties. We may receive information related to you through our trusted marketing partners. Usually, this is related to our, and our partner’s, interest in making sure any products or services you are presented with are of interest to you.

 

4. Cookies. Cookies are text files containing small amounts of information which are downloaded to your device when you visit a website. Cookies are then sent back to the originating website on each subsequent visit, or to another website that recognizes that cookie. Cookies are useful because they allow a website to recognize a user’s device.

Cookies perform different functions such as letting you navigate between pages efficiently, remembering your preferences, and generally improve the user experience. The kinds of the cookies that may be used on the Sites is set out below:

• Strictly necessary cookies are essential in order to enable you to move around the Sites and use its features, such as accessing secure areas of the Sites. Without these cookies, certain services you have asked for cannot be provided.

• Performance cookies collect information about how you use the Sites, for instance which pages visitors go to most often, and if they get error messages from web pages. • Marketing cookies and pixel tags are technologies which we use to better understand your interests related to our, and our marketing partners, products and services. Some browsers and browser extensions support the Global Privacy Control (“GPC”) that can send a signal to process your request to opt out from certain types of data processing, including data "sales" as defined under certain laws. Simplicity does not collect sensitive Personal Information through our Sites, as defined by applicable law.

 

Payment Processing

All payments shall be processed through our payment processor Stripe. We do not process or store payment card details. For more information, please see Stripe’s Terms of Service.

 

How We Use the Information We Collect

In our normal course of business, we use Personal Information to respond to your inquiries. We may also use Personal Information to notify you of events, products, or services that we think may be of interest to you. Additionally, Simplicity uses Personal Information about you for the following purposes:

• to establish or maintain our relationship with you;

• to contact you and respond to your requests and inquiries;

• to provide you with products or services you have requested;

• to provide you with information related to our, and our marketing partners, goods and services you may be interested in;

• to keep you informed of products and services we think may be of interest to you, including those of our affiliated brands;

• to personalize your experience with us and to assist you while you use the Sites;

• for business administration, including statistical analysis;

• to improve the Sites by helping us understand who uses the Sites;

• to protect the interests of visitors to our Sites, our employees, and other third parties;

• to investigate violations of our policies and applicable law;

• for fraud prevention, and detection and to comply with applicable laws, regulations or codes of practice; or
• as part of any contemplated or actual sale of all or some of the assets of Simplicity.

We do not sell or share Personal Information. We may de-identify or aggregate Personal Information so that it can no longer reasonably be used to identify you. We may use such data for research, analytics, or to improve our services.

 

How We Retain Information We Collect

We will retain Personal Information for as long as necessary or permitted in light of the purposes described in this Policy. However, some Personal Information may be retained for longer periods as required by law, contract, or auditing requirements. We will also retain Personal Information for as long as necessary to establish, exercise, or defend legal claims, or as otherwise permitted by applicable law.

 

How We Disclose Information We Collect

We may transfer or subprocess Personal Information:

• to our service providers (such as our customer support specialists and email campaign providers, payment processors, etc.) who are only permitted to use the information to provide services to us and you;

• as required by law or legal proceeding or to protect our or others’ legal rights; and

• in connection with an acquisition, merger, sale, or other transfer of all or any portion of our business.

We may share other information (which does not identify you personally) with any party for any purpose we deem appropriate.

Email Marketing

You may choose to opt out of receiving future marketing or promotional email messages from us by using the “unsubscribe,” “opt- out”, or similar option contained in the email message or by emailing us at privacy@simplicity.com. We may always email you in response to your correspondence to us or in connection with any other transactions you have with us.

 

SMS Text Messages

If you have opted into SMS text messaging, we may contact you periodically by SMS to provide information regarding events, products, services, and content that may be of interest to you ("SMS marketing"). If you wish to stop receiving SMS marketing messages, you can reply "STOP" to any SMS marketing message you receive from us. Please note that opting out of SMS marketing will not prevent us from sending you non-promotional SMS messages, such as those related to your orders, account verification, or other service-related communications.

Data Transfers

Where you are located in the European Economic Area (“EEA”), Personal Information collected from you will be transferred to recipients in countries located outside the EEA which do not provide a similar or adequate level of protection to that provided by countries in the EEA. We will take appropriate steps to ensure that any Personal Information is treated securely and in accordance with this Policy.

You may be entitled to the following privacy rights listed below based on various state privacy laws, including if you are a resident of California, Colorado, Connecticut, Florida, Montana, Oregon, Texas, Utah and Virginia:

The rights to know/access. You may have the right to request to access or know (i) the specific pieces of Personal Information we have about you; (ii) the categories of Personal Information we have collected about you; (iii) the categories of sources from which that Personal Information was collected; (iv) the categories of Personal Information we have sold or disclosed; (v) the categories of third parties to whom your Personal Information was sold or disclosed; and (vi) the purposes for collecting and selling your Personal Information. Generally, we collect the categories of Personal Information detailed above; and we have disclosed the categories of Personal Information detailed above.

The right to correction. You may have the right to request that we correct the Personal Information that we have collected or maintain about you.

The right to deletion. You may have the right to request that we delete the Personal Information that we have collected or maintain about you. We may deny your request under certain circumstances, such as if we need to comply with our legal obligations or complete a transaction for which your Personal Information was collected. If we deny your request for deletion, we will let you know the reason why.

The right to restrict or opt out of the sale or sharing of your Personal Information. You may have the right to opt out of the sale or sharing of your Personal Information.

The right to equal service. If you choose to exercise any of these rights, we will not discriminate against you in any way. If you exercise certain rights, understand that you may be unable to use or access certain features of our services.

The right to data portability. You may have the right to request your personal data in a format that is portable and usable.

You may request your right to know and your right to deletion free of charge up to two (2) times in any twelve (12) month period.

California “Shine the Light” Disclosure (California Civil Code § 1798.83)

If you are a California resident, you may request information about our disclosure of certain categories of Personal Information to third parties for their direct marketing purposes during the preceding calendar year. This request may be made once per calendar year and is free of charge. Please include “California Shine the Light Request” in your subject line or letter and provide a current California address for our response. We will respond within the timeframe required by California law.

Please note that not all sharing is covered by this law, and our response will include only information required by California Law. Where we provide you with a choice to opt out of certain disclosures or otherwise provide information about how we share Personal Information along with a cost-free means to opt out, we may direct you to information on how to exercise that choice in lieu of providing specific details about third-party marketing disclosures.

Legal Basis for Processing Personal Information

The legal basis for our processing of Personal Information about you are as follows:

• Contract: When you purchase a product from us, we collect Personal Information about that is necessary for completing that transaction and delivering the product to you;

• Consent: We obtain your consent to collect Personal Information for distinct purposes such as receiving marketing communications from us. You have the right to withdraw your consent at any time.

• Legitimate Interest: We have a legitimate interest to collect Personal Information about you for certain purposes such as data analytics and the protection and administration of the Website so that we can (i) understand our customers’ preferences and improve the product selection available on the Website; (ii) to protect the Website from information security threats and our Company in connection with legal claims and proceedings; (iii) to communicate administrative changes in connection with the use of the Website; and (iv) to comply with laws that apply to us and the Website.

We do not engage in or have features that engage in automated decision-making. If this changes, we will update our Policy accordingly.

Children’s Data

The Sites are not intended for or directed to children under eighteen (18) years of age, and Simplicity does not knowingly collect Personal Information from such individuals. If you are younger than eighteen, you may not use the Sites.

Simplicity seeks to adopt appropriate physical, technological and organizational security measures that are consistent with industry practice in order to assist with protection against the loss, misuse, and alteration of Personal Information that is under our control. However, no website, mobile application, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your personal data transmitted to, through, using, or in connection with the Services.

Simplicity reserves the right to update and revise this Policy at any time and from time to time, as it deems necessary or appropriate. You may determine if this Policy has been revised since your last visit by referring to the "Effective Date" date noted at the top of this page.
